Terms of service

Welcome to Asian Cougar LLC (“Asian Cougar,” “we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of our websites, online shop, membership program, booking tools, events pages, and any content or services we provide (collectively, the “Services”).

Please read carefully. By accessing or using the Services, you agree to these Terms and our [Privacy Policy]. If you don’t agree, do not use the Services.

1) What we are

Asian Cougar is a creative studio and tattoo practice. Our Services include:

  • Information about our studio, artists, and work

  • Online booking requests and intake/consent flows

  • An e-commerce shop for merchandise and publications

  • Members-only content and benefits (e.g., VIP, BTS)

  • Portfolio, news, and event updates

Some features are informational only; others involve purchases or subscriptions.

2) Eligibility & accounts

  • Age. The Services are for users 18+. Tattoo services are strictly 18+ with valid government-issued photo ID (unless otherwise required by local law and expressly permitted by our studio policies).

  • Accounts. Certain features (e.g., memberships) may require an account. Keep your login secure—you’re responsible for all activity under it. Tell us right away if you suspect unauthorized use.

3) Store, bookings, and subscriptions

Orders. We may accept, decline, or cancel any order or booking request at our discretion (for example, due to availability, suspected fraud, or policy). You’ll receive email confirmations where applicable.

Payments. Online payments are processed by third-party providers (e.g., Stripe, PayPal, Apple Pay). We don’t store full card numbers. You authorize us and our processors to charge your selected method for purchases, deposits, and any applicable taxes, shipping, or fees.

Memberships (recurring). If you join a paid tier (e.g., VIP, BTS), you authorize recurring charges until you cancel. We’ll describe the cadence and price at checkout. You can cancel anytime effective at the end of the billing period (no partial refunds unless required by law).

Shipping & delivery. Timeframes shown at checkout are estimates. Multiple shipments may occur. Risk of loss passes to you upon carrier’s receipt.

Returns. Unless a specific product page states otherwise, all sales are final. If there’s an issue with your order, contact brand@asiancougar.com within 5 days of delivery and we’ll do our best to resolve it.

Deposits. Tattoo deposits are generally non-refundable and applied to your final balance, subject to the booking terms shown at the time you schedule.

4) Health, intake & consent

For tattoo services we may require intake/consent forms, age/ID verification, and limited health information (e.g., allergies, medications) to assess suitability and to meet safety/legal requirements. See the Privacy Policy for how we handle this data.

5) Platform & third-party services

  • Hosting/E-commerce. The site runs on Squarespace. Data may be stored on their secure servers.

  • Payments. Processed via third parties (e.g., Stripe/PayPal/Apple Pay) under their terms and privacy notices.

  • Other providers. We use tools for analytics, email, scheduling, shipping, and marketing. Some providers may be outside your country.

  • Links. We may link to third-party sites. We’re not responsible for their content or practices—check their terms and policies.

6) Communications

By using the Services, you agree we may contact you about your orders, bookings, membership, or account (e.g., emails, texts, push notifications). Marketing messages are opt-in and you can unsubscribe anytime (see Privacy Policy).

Standard carrier rates may apply for texts or data.

7) Acceptable use

Do not, and do not attempt to:

  • Break the law or violate these Terms

  • Interfere with or damage the Services (e.g., hacking, scraping, reverse engineering)

  • Upload or share unlawful, infringing, harassing, hateful, obscene, or otherwise objectionable content

  • Impersonate others or misrepresent your affiliation

  • Spam or send unauthorized advertisements

We may remove content, suspend features, or restrict access at our discretion.

8) Intellectual property

The Services and all content we provide (text, graphics, images, video, designs, logos, trademarks, and code) are owned by Asian Cougar or our licensors and are protected by law. Except as expressly allowed here, you may not copy, modify, distribute, sell, or create derivative works from the Services or their content without our prior written consent.

Limited license. We grant you a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial use in accordance with these Terms.

9) User content & portfolio rights

If you upload, post, or submit content (e.g., comments, images you provide), you represent you have the necessary rights and that your content doesn’t infringe others’ rights or violate law. You grant Asian Cougar a worldwide, royalty-free license to use, host, store, reproduce, adapt, publish, and display your content for operating and improving the Services.

Tattoo photography. If you consent, we may photograph fresh or healed tattoos for our portfolio, social media, or marketing. This consent is optional and separate from service consent (see Privacy Policy). You can withdraw future use by contacting us; prior lawful uses may persist in archival or social posts already published.

IP concerns (DMCA-style). If you believe something on our Services infringes your IP, email brand@asiancougar.com with: (1) your contact info; (2) the work allegedly infringed; (3) the exact URL or description of the material; (4) a statement of good-faith belief; and (5) your signature (electronic is fine). We’ll review and respond as appropriate.

10) Disclaimers

We provide the Services “as is” and “as available.” To the maximum extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and that the Services will be uninterrupted, timely, secure, or error-free. Any downloads or use are at your own risk.

11) Limitation of liability

To the fullest extent permitted by law, Asian Cougar and our owners, employees, contractors, and affiliates are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or business, arising out of or related to your use of the Services.

Our total liability for any claim related to the Services will not exceed the amount you paid to Asian Cougar for the specific transaction or membership giving rise to the claim.

Some jurisdictions don’t allow certain limitations; in those cases, we limit our liability to the maximum extent permitted.

12) Indemnification

You agree to indemnify and hold harmless Asian Cougar, our owners, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your (a)use of the Services, (b) violation of these Terms, or (c) infringement or violation of any third-party rights.

13) Dispute resolution; class-action waiver

Informal resolution first. If there’s an issue, email hi@asiancougar.com and we’ll try to resolve it.

Arbitration (U.S.). Except for claims for injunctive or equitable relief relating to IP or unauthorized use of the Services, you and Asian Cougar agree to resolve disputes by binding, individual arbitration administered by the AAA under its applicable rules. No class actions or class arbitrations. The arbitration will take place in Chicago, Illinois, unless we both agree otherwise. Judgment on the award may be entered in any court with jurisdiction. This section is governed by the Federal Arbitration Act.

Opt-out. You can opt out of arbitration within 30 days of first accepting these Terms by emailing brand@asiancougar.com with subject “Arbitration Opt-Out” and your full name and account email. If you opt out, you agree that exclusive jurisdiction and venue will be in the state or federal courts located in Cook County, Illinois.

14) Changes to the Services or these Terms

We may update the Services and these Terms from time to time. When we make material changes, we’ll update the “Last Updated” date and, where appropriate, provide additional notice. Continued use of the Services after changes means you accept the updated Terms.

15) Termination

You may stop using the Services anytime. We may suspend or terminate access (including accounts or memberships) at any time for any reason, including suspected misuse or violations of these Terms. Sections that by nature should survive termination will survive (e.g., IP, disclaimers, liability limits, indemnity, dispute resolution).

16) General

  • Governing law. These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law rules.

  • Severability. If any part of these Terms is invalid, the rest remains in effect.

  • No waiver. Our failure to enforce a provision isn’t a waiver of our right to do so later.

  • Assignment. You can’t assign these Terms without our consent. We may assign them in connection with a merger, sale, or reorganization.

  • Entire agreement. These Terms + Privacy Policy are the entire agreement between you and us regarding the Services.

  • Third-party beneficiaries. Except as expressly stated, there are none.
